Preparation Time:

If the parties supply the mediator with informative pre-mediation statements, no preparation fee will be imposed for time spent reviewing the same. If any party fails to provide a pre-mediation statement, the failing party will be charged the full hourly rate for preparation time incurred by the mediator.

Minimum Rates:

• 2 Hour minimum
• No travel time charged within the Florida Keys
• One half the hourly rate for travel outside of the Florida Keys

Payment Terms:

All parties are to remit the initial minimum payment to the mediator... Unless other arrangements are made with the mediator in advance of the mediation, all parties are to remit payment to the mediator on the date of mediation. The balance of the mediator’s fee, if any, shall be due and paid at the conclusion of the mediation.

Responsibility of Attorneys:

Notwithstanding the fact that counsel is acting as agent for a disclosed principal, the attorney’s client, in consideration of the mediator setting aside time to mediate the dispute without requiring prepayment of fees, each party’s attorney, if any, undertakes the obligation to guarantee timely delivery of that party’s mediation fees.

Cancellation Policy:

To honor and respect the party’s and attorney’s time, ONLY ONE MEDIATION IS SCHEDULED PER DAY. Therefore, notice of cancellation or postponement of a scheduled mediation conference must be received at least 3 full business days (excluding weekends and holidays) prior to the scheduled commencement of the mediation conference. Absent such timely notification, the parties will be billed the pro rata share of a $800.00 cancellation fee.
